Objection of SIA "Robologic" to the Statement of Claim in the Court Case Nr.C770950325
Atbilstoši minētā panta otrajai daļai virsstundu darbs ir pieļaujams tikai tad, ja darbinieks un darba devējs par to ir rakstveidā vienojušies, izņemot šā panta trešajā daļā noteiktos izņēmuma gadījumus.
Darba likuma 136. panta trešā daļa paredz izņēmuma gadījumus, kad darba devējam ir tiesības nodarbināt darbinieku virsstundu darbā bez viņa rakstveida piekrišanas, proti, sabiedrības neatliekamu vajadzību gadījumā, nepārvaramas varas vai citu ārkārtēju apstākļu seku novēršanai, kā arī steidzama, iepriekš neparedzēta darba pabeigšanai. Prasītājs prasības pieteikumā nav norādījis un nav pierādījis, ka kāds no minētajiem izņēmuma gadījumiem būtu pastāvējis.
Pamatprincips paredz, ka darba devējs nav tiesīgs vienpersoniski noteikt darbiniekam pienākumu strādāt virsstundas, tāpat arī darbinieks nav tiesīgs strādāt virsstundas pēc savas iniciatīvas, to nesaskaņojot ar darba devēju. Darbinieka pienākums strādāt virsstundas rodas tikai gadījumā, ja starp darbinieku un darba devēju ir noslēgta attiecīga rakstveida vienošanās vai pastāv Darba likuma 136. panta trešajā daļā noteiktie izņēmuma apstākļi.
Atbildētājs paskaidro, ka starp Atbildētāju un Prasītāju nav bijusi noslēgta rakstveida vienošanās par virsstundu darba veikšanu, kā arī Atbildētājs Prasītājam virsstundu darbu nav uzdevis, pieprasījis vai saskaņojis. Prasītājs strādāja atbilstoši Atbildētāja sastādītajām darba laika uzskaites tabelēm, kurās virsstundu darbs nav fiksēts.
Atbildētājs arī norāda, ka, lai gan tiesību doktrīnā ir atzīts, ka gadījumā, ja darba devējs faktiski akceptē virsstundu darbu (neveic darbības, lai to novērstu), var rasties pienākums samaksāt par virsstundām, konkrētajā lietā šāds akcepts nav konstatējams. Atbildētājs nav devis Prasītājam norādījumus strādāt virsstundas, nav pieņēmis virsstundu darba rezultātus kā virsstundu darbu un nav apstiprinājis Prasītāja norādīto virsstundu apjomu. Turklāt, ja virsstundu veikšana ir bijusi paša Prasītāja iniciatīva, tā pati par sevi nerada Atbildētājam pienākumu maksāt par virsstundām. Atbildētājam nebija zināms par Prasītāja apgalvotajām nostrādātajām virsstundām, un Atbildētājs par iespējamu virsstundu darbu uzzināja tikai pēc prasības pieteikuma saņemšanas. Līdz ar to Atbildētājs nevarēja šo darbu uzdot, saskaņot var faktiski akceptēt.
Turklāt jāņem vērā, ka komandējumu laikā Vācijā darbs tika veikts pie klientiem, kuri ir lieli autorūpniecības uzņēmumi, un darbs notika šo uzņēmumu rūpnīcās, kur darba laiks ir stingri reglamentēts.

Part 3 of Article 136 of the “Labor Code” lists the exceptional cases, when an employer has the right to employ an employee on overtime without his or her written consent in the following exceptional cases: if this is required by the most urgent public need; to prevent the consequences caused by force majeure, an unexpected event or other exceptional circumstances which adversely affect or may affect the normal course of work activities in the undertaking; for the completion of urgent, unexpected work within a specified period of time. In the complaint, the plaintiff did not allege or prove the existence of any of the circumstances mentioned.
The basic principle is that an employer does not have the right to unilaterally require an employee to work overtime, just as an employee does not have the right to work overtime on his or her own initiative without the employer’s consent. An employee is obligated to work overtime only if a written agreement to that effect has been entered into between the employee and the employer, or if there are exceptional circumstances as specified in Part 3 of Article 136 of the “Labor Law.”
The Defendant explains that no written agreement regarding overtime work was entered into between the Defendant and the Plaintiff. Furthermore, the Defendant did not assign, require, or approve any overtime work for the Plaintiff. The plaintiff worked in accordance with the time sheets prepared by the defendant, which did not record any overtime.
The defendant also points out that although legal doctrine recognizes that where an employer effectively accepts overtime work — that is, does not take steps to prevent it — an obligation to pay for overtime hours may arise, in the present case there is no such acceptance. The Defendant did not instruct the Plaintiff to work overtime, did not recognize the hours worked as overtime, and did not confirm the number of overtime hours claimed by the Plaintiff. Furthermore, if the Plaintiff’s overtime work was performed on his own initiative, that fact alone does not obligate the Defendant to pay for the overtime hours. The Defendant was not aware of the overtime hours claimed by the Plaintiff and only learned of the possible overtime work after receiving the complaint. It follows that the Defendant could not have assigned, authorized, or effectively accepted this work.
